Terms of Use

Balmainopolis (the “Game”, “app”, “we”, “us” or “our”) is a real-world strategy game operated by Local Darlings, a team brought to you by Coalfacer Pty Ltd, ABN 80 163 952 289. These Terms of Use (“Terms”) govern your access to and use of the Balmainopolis app, website and any related services.

By creating a game, joining a game, or otherwise using the app, you agree to these Terms. If you do not agree, please do not use the app. If you are under 18, you may only use the app with the involvement and consent of a parent or guardian.

Balmainopolis is played in the real world, on foot (rollerskates and bikes are obviously welcome!), across the parks and public spaces of the Balmain peninsula. You are responsible for your own safety and the safety of your team at all times while playing. Safety first!

You must obey all road rules, traffic signals, park regulations and local laws while playing. Pay attention to your surroundings, other people, vehicles and hazards. Do not trespass on private property, enter restricted areas, or play in a way that is dangerous, disruptive or a nuisance to others.

The game is intended to be a fun, friendly rivalry. Do not use the game to harass, intimidate or endanger other players or members of the public.

To play, you need to create a game or join one using details your personal details, including email address of your team members (or their guardian) and have a phone with the app installed on it. You are responsible for keeping your account and game access secure, and for all activity that happens under your account or team.

You agree that the information you provide to us is accurate and that you will keep it up to date.

Balmainopolis uses your team captain's device GPS and location services to track your team's progress, register check-ins at landmarks, and run the game. The app will not work as intended if location services are disabled. Our handling of location and other data is described in our Privacy Policy.

You are responsible for your own device, mobile data, battery and connectivity while playing. We are not responsible for costs, damage or loss relating to your device.

You agree not to cheat, exploit bugs, use automated tools or scripts, spoof your location, reverse engineer the app, or otherwise interfere with the fair operation of the game.

You agree not to use the app for any unlawful purpose, or to upload, share or transmit content that is unlawful, offensive, or infringes the rights of others.

The Balmainopolis name, logo, game design, artwork, text and software are owned by us or our licensors and are protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable licence to use the app to play the game. You may not copy, resell, or create derivative works from the game without our written permission.

You consent to our use of content you submit in the game, including photos, challenge submissions and team name in our marketing collateral. You acknowledge that some content you create forms part of the perpetual game experience and may be visible to participants playing in other games. You agree not to submit content that is offensive, defamatory, or infringes the rights of others and to create content that is sensitive to your privacy considerations (for example, if you find yourself visiting The Lock Up, our mugshot wall is perpetual - so choose your angle with care (the back of your head, your hands of feet will be accepted for submission in the game).

Balmain Bucks, assets, portfolios and other in-game items have no monetary value, cannot be exchanged for real money or goods, and may be changed, reset or removed at any time. They exist only within the game.

The app is provided “as is” and “as available”. To the extent permitted by law, we make no warranties that the app will be uninterrupted, error-free or suitable for your purposes.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or for any injury, loss or damage arising from your participation in the game or your use of the app, except where such liability cannot be excluded by law.

We may suspend or terminate your access to the app if you breach these Terms or misuse the game. We may also update, change or discontinue the app or these Terms from time to time. Where we make material changes to these Terms, we will update the “last updated” date and, where appropriate, notify you in the app.

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
